General Terms and Conditions (GTC)

§ 1 Scope
These General Terms and Conditions apply to all orders placed through the PALANDOS online shop at palandos.de.
Our online shop is exclusively aimed at consumers.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
Orders from entrepreneurs are excluded via this online shop.
Deviating conditions of the customer are not recognized, unless we expressly agree to their validity in writing.
§ 2 Contracting party and conclusion of contract
The contracting party is Miliya GmbH, brand PALANDOS.
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
By clicking the "Buy now" or "Order with obligation to pay" button, you submit a binding offer to conclude a purchase agreement for the goods contained in the shopping cart.
Immediately after submitting the order, you will receive an automated order confirmation by email. This confirmation merely documents that your order has been received by us. It does not yet constitute acceptance of your offer.
The purchase contract is only concluded when we accept your order through an express order confirmation by email or by shipping the goods.
Even with immediate payment, especially via PayPal, credit card, Klarna, SOFORT, or Shopify Pay, we reserve the right to reject or cancel an order and refund any payment already made, particularly in cases of availability bottlenecks, obvious price errors, system errors, or justified suspicion of fraud.
§ 3 Contract language and contract text storage
The language available for the conclusion of the contract is German.
We store the contract text and send you the order data and these GTC in text form, in particular by email. The contract text is no longer accessible via the internet for security reasons after the order has been placed.
§ 4 Prices and payment terms
All prices are final prices including the statutory value added tax. Shipping costs are shown separately and can be found on the respective product page and in the checkout.
The invoice amount is due immediately upon completion of the order.

If you choose the prepayment payment method, we will send you our bank details separately. Shipping will take place after receipt of payment.
For payment by credit card, PayPal, PayPal Express, Klarna, SOFORT, or Shopify Pay, the payment processing is carried out by the respective selected payment service provider according to their terms and conditions. The payment methods and information displayed in the order process are decisive.
For individual payment methods, especially for Klarna services, an address and credit check may be carried out by the respective payment service provider.
§ 5 Delivery
Delivery will be made to the delivery address you provide.
Details on delivery times and shipping costs can be found on our shipping page.
We only deliver by shipping. Self-collection of goods is not possible.
We reserve the right to make partial deliveries, provided this is reasonable for you.
§ 6 Retention of title
The delivered goods remain the property of Miliya GmbH until full payment of the purchase price.
§ 7 Right of withdrawal for consumers
Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

§ 9 Returns and Refunds
In the event of an effective withdrawal, we will refund all payments we have received from you, including delivery costs, without delay and at the latest within fourteen days from the day on which the notification of your withdrawal was received by us.
For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You bear the direct costs of returning the goods.
Please return the goods, if possible, in their original packaging and with all accessories. This is not a prerequisite for the effective exercise of the right of withdrawal.
§ 10 Warranty and Guarantee
The statutory warranty rights apply.
The limitation period for statutory claims for defects is two years from the delivery of the goods.
If additional manufacturer's guarantees exist, their conditions result from the respective product descriptions or the manufacturer's guarantee documents.
Any limitations of liability according to § 12 of these GTC do not apply to claims for defects, insofar as mandatory statutory provisions stipulate otherwise.

§ 12 Liability
We are liable without limitation

for damages resulting from injury to life, limb, or health

for damages based on intentional or grossly negligent breach of duty by us, our legal representatives, or vicarious agents

in case of malice

under the Product Liability Act

and to the extent of an expressly assumed guarantee
In the event of a slightly negligent breach of essential contractual obligations, i.e., obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance you can regularly rely, our liability is limited to the contract-typical, foreseeable damage.
Otherwise, liability for damages is excluded, to the extent legally permissible.
§ 13 Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.
